The Appendices: DOJ's Own Guidance
The regulation itself is only half the story. Five appendices to 28 CFR Part 35 contain the Department of Justice's official interpretive guidance — the reasoning behind the rules. Here's what each one covers and when you'd reach for it.
- Appendix A Guidance to revisions of the 2010 rule
DOJ's section-by-section analysis of the 2010 amendments — the closest thing to an official explanation of what each provision means and why it was written that way. Courts cite it regularly.
- Appendix B Guidance on the original 1991 regulation
The Department's preamble guidance to the original Title II rule. Still relevant for provisions that haven't changed since 1991.
- Appendix C Guidance on the definition of disability
Explains the 2016 amendments implementing the ADA Amendments Act: how 'disability' must be construed broadly, and what that means for coverage decisions under §35.108.
- Appendix D Guidance on the web and mobile accessibility rule
DOJ's analysis of Subpart H: how the WCAG 2.1 AA requirement works, how the exceptions apply, and how compliance will be assessed. Essential reading alongside §§ 35.200–35.205.
- Appendix E Guidance on accessible medical diagnostic equipment
DOJ's analysis of Subpart I: scoping percentages, the exam table and weight scale requirements, and qualified staff duties under §§ 35.210–35.213.

The appendices run hundreds of pages. The full text is published with the regulation in the Code of Federal Regulations. Start with our section pages — each one links the concepts you actually need — and go to the appendices when you need DOJ's full reasoning on a specific point.
