§ 35.106 Notice

Requires public entities to inform people with disabilities about their rights and the entity's obligations.

Public entities must tell people with disabilities and the public generally about their rights under Title II and the entity's obligations. This notice requirement ensures that people who need accommodations know they can request them and know how to contact the entity's ADA Coordinator. Notice must be provided in accessible formats.

A public entity shall make available to applicants, participants, beneficiaries, and other interested persons information regarding the provisions of this part and its applicability to the services, programs, or activities of the public entity, and make such information available to them in such manner as the head of the entity finds necessary to apprise such persons of the protections against discrimination assured them by the Act and this part.

What § 35.106 Means in Practice

  • Your entity must publish information about Title II and your ADA obligations
  • Notice should include how to request accommodations or auxiliary aids
  • Contact information for your ADA Coordinator must be publicly available
  • Notice must itself be accessible. Publishing it only in inaccessible formats defeats the purpose
  • Your website is a primary notice channel. ADA information should be findable and readable
